2. Contracting party

3. Offer and delivery
The offer is visible on the website seyu.ch and is non-binding. Product information is primarily for illustration purposes and is non-binding. We reserve the right to make price and product range changes as well as technical changes. The offers are only valid as long as they are visible on the website and while stocks last.
In the online shop, the buyer submits a legally binding offer to conclude a contract by submitting his order and simultaneously accepting these terms and conditions. The contract is concluded at the time the buyer receives an order confirmation from the seller by email. The delivery method and delivery costs are shown in the online shop.
Information on availability and delivery times is not binding. If an article is not available in stock, the buyer will be informed as soon as possible when delivery can be expected. The seller is not liable for delivery delays caused by manufacturers or third parties. All information on delivery times is therefore without guarantee and can change at any time. Delivery is at the buyer's risk and expense.
4. Price information and payment
Prices are in Swiss francs (CHF). Published prices and conditions are subject to change, with the effective date being the day the order is placed by the buyer.
Payment for the ordered goods is made in advance, either by credit card or via PayPal. For online payments, the value of the goods is charged on the day the order is received. The seller reserves the right to exclude buyers from certain payment options without giving reasons. Invoices are payable within 30 days of receipt. The seller reserves the right to charge reminder fees of at least CHF 20.00 and other collection fees after the second reminder. The right to transfer the payment to a collection agency remains reserved.
When paying by credit card, the contract and data protection provisions of Stripe (http://www.stripe.com) or Paypal (http://www.paypal.com) apply.
The delivered goods remain the property of the seller until full payment has been made. The seller is entitled to make a corresponding entry in the retention of title register. If the buyer defaults on payment of the purchase price, the seller is entitled, among other things, to withdraw from the contract and repossess the goods.
5. Warranty and Liability
Complaints about defects or incomplete or incorrect deliveries must be reported to the seller in writing immediately, but no later than 14 days after delivery. Hidden defects must be reported to the seller in writing immediately, but no later than 14 days after discovery. If the buyer fails to report the defect in a timely manner, his claims expire. After returning the goods complained about, the buyer will receive a replacement delivery if there is a defect. If a replacement delivery is not possible, the seller will refund the payment made. The buyer forfeits any rights to defects if the goods are used improperly. Defects resulting from normal wear and tear, as well as those resulting from improper handling or damage by the buyer or third parties, and defects that are attributable to external circumstances (improper storage, frost, heat, moisture, incorrect storage, etc.) do not entitle the buyer to withdraw from the contract or to replace the goods. The seller assumes no liability for this. Returns of goods are at the buyer's expense and risk. The products must be properly packed in the original packaging and sent by registered mail. If the seller cannot identify any defects that are covered by the warranty or are covered by the manufacturer's guarantee, the seller can charge the buyer for the costs of inspecting and shipping the goods.
Other claims by the buyer - regardless of the legal basis - are excluded to the extent permitted by law. The seller, its assistants and any vicarious agents are not liable for damages that did not arise from the goods themselves, in particular not for consequential damages, lost profits or other financial losses of the buyer. Any liability of the seller in connection with the offer (in particular incorrect images, texts and prices) and the delivery is excluded to the extent permitted by law.
6. Cancellation, return and cancellation rights of the buyer
Orders from the buyer are binding and the customer is obliged to accept the service. Subsequent changes at the customer's request are possible at the seller's discretion. The buyer has the right to return the goods within 14 days of receipt and to cancel the contract. The right of return can only be legally exercised if the goods are returned unused, undamaged, complete and in the original packaging. After receipt of the goods returned in the described condition, the seller will reimburse the buyer for the value of the goods. The goods must be returned at the buyer's expense, benefit and risk. 9. Applicable law and place of jurisdiction
All contracts concluded with the seller are subject to Swiss law, excluding the substantive rules of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). If orders are placed by private individuals for private use, the place of jurisdiction is determined by the consumer protection regulations. In all other cases, Zurich is the exclusive place of jurisdiction.
